Booking
Conditions: No booking will be
confirmed until the booking form has been completed and received by
Ocean Adventures Sailing with payment of a 25% deposit if prior to
six weeks before the course/cruise dates. The balance is
payable six weeks before the course/cruise. Bookings less than
six weeks prior to these dates require payment in full at time of
booking. Provisional bookings will be held for a maximum of 5 days.
Ocean Adventures Sailing reserves the right to offer any unconfirmed
places for resale.
Cancellation: In the event of cancellation more than six
weeks before the commencement date of the course or event, any
amounts paid, except the deposit, will be refunded. For
cancellations less than six weeks prior to the course, any refund
will be subject to Ocean Adventures Sailing re-selling the places/berths.
Amendments to Bookings: Any alteration to a booking must be made in
writing to Ocean Adventures Sailing. Date changes will only be
accepted if written confirmation is received by the office more than
six weeks prior to the course/cruise. Within six weeks of the
start date of the course/cruise, any date change will be considered
a cancellation and cancellation charges will apply.
Safety: In the interest of safety, the Ocean
Adventures Sailing skipper has sole authority for course/cruise
safety decisions, taking into account weather conditions and an
assessment of the clients� abilities. Every effort will be
made to ensure cruises visit the destinations listed, but Ocean
Adventures Sailing reserves the right to change the itinerary if, in
the view of the Skipper, weather or other factors necessitate this.
What is Included: For practical courses/cruises,
accommodation and meals on board as listed, mooring/berthing
charges, instruction as offered, all safety equipment and
waterproofs if required. For theory
courses, accommodation and meals are not
included in the price.
Boats: Whilst every effort will be made to provide
the boat booked, in the event of the unavailability of the boat,
Ocean Adventures Sailing reserves the right to substitute a similar
boat, re-arrange the dates, or cancel. In the event of cancellation
each participant will be offered a full refund or a credit of any
monies paid. All yachts used for teaching RYA Courses are MCA coded
and approved by the Royal Yachting Association as suitable for the
teaching of sailing.
Insurance:
Ocean Adventures Sailing is insured against accident and third party
liability for �2,000,000. This does not cover clients�
persons or property. Whilst Ocean Adventures Sailing takes
every RYA recommended action to prevent injury or loss to any
client, the company does not accept liability for any injury or loss
to a client not caused by negligence. All clients are strongly
recommended to purchase personal insurance against cancellation,
injury or loss.
Liability: Ocean Adventures Sailing, in common with the
RYA, encourages the wearing of lifejackets at sea. Any client
unable to swim 50 metres must agree to wear a lifejacket at all
times when on deck. All clients must wear lifejackets when using a
dinghy or tender. Ocean Adventures Sailing must be informed of any
medical conditions that might affect the client�s participation in
a course/cruise. Ocean Adventures Sailing does not accept
liability for personal injury to, or the death of, any participant,
however caused, nor for any loss or damage resulting from this,
unless caused by proven negligence of the company. Ocean
Adventures Sailing does not accept responsibility for any
curtailment or cancellation due to weather, strikes, riots, wars or
any other causes outside the control of the company. Personal
safety and personal property remain the personal responsibility
of each client.
Variation of Conditions: No variation in these conditions of booking
will be accepted unless given in writing by the Principal of Ocean
Adventures Sailing, or his representative.
Alterations: All promotional details are given in good
faith, but we reserve the right to provide alternative comparable
arrangements if for any reason we decide such alterations are
necessary. In the very unlikely event that a yacht is unavailable,
or that a shore-based course must be cancelled, Ocean
Adventures Sailing reserves the right to substitute a similar boat,
rearrange the dates, or cancel. In the event of cancellation each
participant will be offered a refund or a credit, limited to fees
paid.
Suggestions
for Improvement or Complaints:
Ocean Adventures Sailing prides itself on the standard of its
courses/cruises. To enable us to maintain this standard, we welcome
any comments from clients. For this purpose, each client is
requested to fill in a feedback form on completion of the
course/cruise. If you like what we do, tell your friends; if
you do not, tell us.
Terms
and Conditions for Online Courses
Ocean
Adventures Sailing work in conjunction with Navathome and is a UK
agent.
Navathome.com
is an RYA recognised training centre.
Although based in Gibraltar courses are available online and run in
conjunction with Ocean Adventures.
Payments
for course fees are due, in full, (unless subscribe 2 payment on
theory courses) at the time of enrolment. Payment
can be made by bank transfer, credit or debit card (i.e. Visa,
Mastercard, Maestro (was Switch), Delta and Solo) using PayPal or by
cheque in GBP, drawn on a UK bank. In the case of payment by cheque
we reserve the right to allow the cheque to clear before dispatching
your student pack.
Students
booking through Ocean Adventures Sailing that work in
conjunction with Navathome which runs the course.
Payment
taken by Ocean Adventures Sailing as UK agent is taken on behalf of
Navathome.
Once
payment has been made and confirmed students will be sent the
student pack and be supplied with the log in information to access
the online course. The student pack will be sent on the next
working day and includes delivery costs up to � 25.00
Additional
fees may be applied to addresses outside of these areas.
There
is a six month time limit set for the course.
Students
will retain log in information until they have completed the course
and on passing their exam will received the relevant certificate.
Students
can extend their access time for a further 6 months for a � 5
registration renewal fee.
Under
Navathome.com cancellation policy you can cancel your purchase up to
7 days from the day of delivery of the student pack.
The
pack must be complete, unopened and in an �as new� condition.
All materials must be returned.
Access
to the online course material is terminated immediately. A refund
will be made less a �30 administration fee.
The
cost of returning the student pack will be payable by the student.
You will not be able to claim a refund if the course material has
been damaged or if you have no proof of purchase.
Students
must have access to the internet and email to complete the course.
The course will run on windows based systems and Apple Mac. Most
systems both of which will already be able to run �Flash active
graphics�, however, this will automatically download when you
start the course if you do not already have it.
Students
will also need to provide a plotter, dividers, 2B pencils and paper.
Students
should be at the correct level for the course being taken. No
previous experience is required to take the Day Skipper theory
course, Day skipper level theory is required for the
Coastal/Yachtmaster theory and Coastal/Yachtmaster theory is
required before taking the RYA Ocean theory.
Ocean
Adventures will provide online back up and land line telephone backup as
required by each student and every endeavour will be made to help
students achieve their aims.
We
will not disclose information about students unless we are legally
obliged to do so or a student has agreed in writing in advance. By
enrolling you confirm that we may hold necessary business
information about you including your name, address, course booking,
payment and course record.
Any
contract between you and us shall be governed by English law and the
courts of England and Wales shall have non-exclusive jurisdiction
over any dispute. All dealings, correspondence and contact between
us and you shall be made or conducted in the English language.
Every
effort has been made to ensure the accuracy of course information.
However, Vic and Lyn Punch, nor navathome.com, cannot accept any
liability for errors, omissions or inaccuracies in the course
content. We continuously improve the course content and we do
welcome any feedback from students which improve the quality of the
course.
All
online material has been written and is under copyright to Vic and
Lyn Punch. No part of the online documents can be reproduced,
stored in or introduced into a retrieval system, or transmitted in
any form or by any means, (electronic, mechanical, photocopying,
recording or otherwise) or for any purpose, without the express
written permission of Vic and Lyn Punch. Course material
should be treated as for any copyrighted material.
